BOOKING CONDITIONS

Thank you for getting this far. We appreciate your business. The following are Ride Holidays LP’s standard terms and conditions. 

WHEN THESE CONDITIONS APPLY

This tour is organised by Ride Holidays LP, represented by Karl Woolcott, Dean Mills and Chris Wood. It is sold subject to the following general conditions and any special conditions recorded on the website trip page (together referred to as the conditions).

By submitting the booking form - you agree to be bound by the conditions. In the event of any inconsistency between these general conditions and any special condition set out on the website tour page, the special condition will prevail to the extent of the inconsistency (except that the limitation and exclusions of our liability in these conditions are paramount and cannot be contracted out of or overridden without explicit reference to the relevant limitation or exclusion).

BOOKINGS AND PAYMENT

To make a booking, you must send us a fully completed, signed booking form and pay the required deposit as per the booking form.

We may in our absolute discretion, without needing to give any reason to you, refuse any booking. If we do so, we will return your deposit to you once your deposit has cleared in our account.

We will invoice you for the balance of the tour cost. You must pay the balance to the account specified in the invoice due date. On the majority of tours this will be no later than 90 days prior to the commencement date of the tour. However – due to COVID-19 some payment dates are different. You will see these on the website page under the individual tours.  

If you fail to pay the balance of the tour costs by the said due date, we may cancel your booking without notice to you and retain the deposit.

If you wish to make a booking within 90 days of the commencement date of the tour, you must pay the full cost of the tour at the time you send us your booking form.

PAYMENT METHODS We accept payment by bank transfer, credit card or international transfer. Payment by credit card or international transfer may incur additional charges.

CANCELLATIONS AND REFUNDS

You may cancel your booking by notifying us in writing. If you cancel your booking the following cancellation charges will apply:

  • notice received by us prior to the date that is 90 days before departure - loss of deposit.
  • notice received by us after the date that is 90 days before departure - 100% of cost.

** Please note that due to Covid-19 there is some flexibility on payment dates. These are listed on the individual tour pages found on the website. 

WE MAY CANCEL OR POSTPONE THE TOUR IF:

  • an unusual or unforeseeable event or circumstance occurs which we consider in our reasonable opinion will be detrimental to the tour or its participants or result in significantly increased costs to tour participants; or
  • the tour does not have the minimum number of participants registered by the date that is 90 days prior to the departure date (minimum numbers are designated on the website tour itinerary page). If we cancel the tour we will endeavour to provide you with replacement travel options.

VACCINATIONS AND COMMUNICABLE DISEASES:

Certain countries will refuse entry to travellers with a communicable disease and require travellers to be vaccinated or immunised against specific diseases (and, in some cases, to carry documentary evidence of vaccination and/or immunisation). You can check these requirements with your doctor and the Embassies of the countries that tour plans to visit.

COVID-19

For the health and safety of all our riders and staff we recommend all those on our trips to be fully vaccinated against COVID-19. This expectation is required given the physical nature of the activities and the close proximity we have to each other while on tour.

INSURANCE

Before you join our tour, you must have comprehensive travel insurance. You are solely responsible for ensuring you have appropriate cover for the tour (including in relation to any pre-existing health conditions and given the nature of the activities which you will be participating in as part of the tour).

ITINERARY

The itinerary is an indication of what the tour involves. Although we will try and keep to the itinerary there are times when, due to events or circumstances beyond our control, we need to be flexible. You acknowledge that such delays and/or alterations to the tour itinerary may occur from time to time and you agree that we are not liable to you for any such delays and/or alterations.

YOUR RESPONSIBILITIES

You are responsible for your behaviour on the tour. We and our transport, accommodation and other service providers (together referred to as our Suppliers) may remove you from any tour, travel, accommodation or activity for disruptive, dangerous, illegal or annoying behaviour and you will not be entitled to any refund or compensation and any costs we or our Suppliers may incur as a result may be passed on to you.

OUR ROLE AND OUR LIABILITY TO YOU

We offer for sale to you - various travel related products and services offered by our Suppliers as an agent and for a fee. All bookings are subject to any terms, conditions or limitations imposed by our Suppliers.

We undertake to perform our services with reasonable skill and care. If we do not perform our services with reasonable skill and care, and you suffer a direct loss as a result we may (at our option):

  • re-perform the relevant service (where practical); or
  • refund the amount of the fees paid to a 3rd party (if any) that we received from you in providing the relevant service to you. (For example – entry to an event that was cancelled, and refunds were offered by the 3rd party to RH. We would refund you)  

HOWEVER:

  • We cannot and do not provide any guarantee, warranty or make any representation (including in any publication which we may provide to you where we are only passing on information provided by our Suppliers) as to the availability, quality or suitability or otherwise of services provided by our Suppliers. You acknowledge that your sole recourse (if any) for such matters is against the relevant Supplier; and
  • you acknowledge that there are hazards and inherent dangers involved in travel and in the pursuit of outdoor activities, including cycling, and that you are required to take out a comprehensive travel insurance policy.

Accordingly, except as expressly set out in the Conditions, we will not be liable to you (whether in contract, tort (including negligence), equity or otherwise) for any loss, damage, injury, disappointment, or discomfort however caused.

If for any reason we are unable to rely on the limitations and exclusions of liability in the Conditions, we will only be liable to you for any direct physical loss that you have suffered and then only for an amount equal to the greater of:

  • the fees (if any) that we have received from our Supplier in relation to providing the relevant service to you; or
  • The deposit you have paid. (as per the booking form or itinerary website page)

PRICES

All prices shown in the Booking Form or in any publication relating to the tour are per adult, in New Zealand dollars and include GST (if any). Prices are subject to availability and can be withdrawn or changed by our Suppliers at any time (even if the tour arrangements have been confirmed and/or you have paid the full quoted cost of the tour). We also reserve the right to correct any error or omission in our advertised or quoted prices. If we have accepted your booking, we will provide you with as much notice as practicable of any such increase to the costs of the tour and you agree to pay the amount of any such increase.

TAXES

You are responsible for all taxes, departure fees or other charges for arrival in or departure from any airport (whether domestic or international) unless we have specified otherwise in the Booking Form. Where such taxes, departure fees or other charges are specified in the Booking Form, these amounts are subject to change and you agree to pay the increase (if any).

PASSPORTS, OVERSEAS ENTRY REQUIREMENTS AND RE-ENTRY REQUIREMENTS

PASSPORTS:

You must provide us with a copy of your passport with your completed Booking Form. It is your responsibility to ensure the information you provide to us is correct and we are not responsible for checking or otherwise verifying the information you provide us (including names, spelling of names and passport numbers). You must be booked on flights under your name as it appears in your passport otherwise you may be unable to board the aircraft. It is important to note that some airlines do not allow name changes once bookings have been confirmed and you may need to purchase a replacement flight.

Your Passport must be in good condition, machine readable, without any sign of wear or tear and have sufficient space for visas and entry stamps gained on route. Some countries require that passports are valid for 6 months after the date of scheduled departure from that country and may deny entry if this requirement is not met. If you have any queries about the validity of your passport please speak directly with the New Zealand Passport office on 0800 22 5050.

VISAS:

Visas or other entry permits may be required for the tour. You should clarify visa requirements with the Embassies of the countries that the tour will visit. Visa requirements may differ depending on whether you are travelling on a New Zealand or a foreign passport. Visas may also be required if you have been sentenced to imprisonment or convicted of certain criminal offences or where you have had a contagious disease or serious health issue (see below). It is your responsibility to ensure that you have the correct visa’s and permits for your travel arrangements. Please note that having a valid visa or entry permit does not guarantee entry to any country.

Re-entry to New Zealand: If you are travelling on anything other than a New Zealand or Australian passport a valid re-entry permit will be required to return to New Zealand. It is your responsibility to ensure that you hold the correct documentation/returning residents visa for re-entry to New Zealand prior to departure. Criminal convictions and unpaid fines: Certain countries will refuse entry to travellers who have a criminal conviction (including certain traffic convictions). You must disclose all previous convictions (if any) before departing New Zealand whether or not you have been arrested and charged, regardless of type of offence, when it occurred or the penalties involved. The Criminal Record (Clean Slate) Act which allows the non-disclosure of criminal convictions in certain circumstances does not apply to overseas countries. If you do have previous convictions speak to your travel consultant about how to proceed (note that visa processing can take up to 8 weeks). GOVERNING LAW:

The agreement between us is governed by and construed in accordance with New Zealand law and you agree to submit to the non-exclusive jurisdiction of the courts of New Zealand in relation to all disputes arising out of or in connection with the agreement between us.

SEVERABILITY:

If any part of the Conditions is held by any court or administrative body of competent jurisdiction to be illegal, void or unenforceable, such determination will not impair the enforceability of the remaining Conditions and the relevant Condition will be deemed to be amended to the minimum extent required to comply with the relevant laws and/or be enforceable.

PRIVACY POLICY: 

We have collected personal information from you and each member of your group for the purposes of arranging travel and other travel related services for you and your group. Our collection and use of personal information is governed by our privacy policy which is available on request.
